CGU - Application Cocon<\/title><\/head><body><article id=\"391cccb0-c7b8-81fb-8734-d47cb31cf9c4\" class=\"page sans\"><header><h1 class=\"page-title\" dir=\"auto\">Terms of Service - Cocon Application<\/h1><p class=\"page-description\" dir=\"auto\"><\/p><\/header><div class=\"page-body\"><h1 id=\"ac145f0c-ef20-4adc-9710-2d16828e3ddc\" class=\"\" dir=\"auto\">I. General Provisions<\/h1><h2 id=\"234bb9ed-9768-4cba-84a4-dc32da6566b6\" class=\"\" dir=\"auto\">Article 1 - Preamble<\/h2><p id=\"d7c3adb2-8009-4ab4-bb62-53c14c6ce456\" class=\"\" dir=\"auto\">These General Terms and Conditions of Use (hereinafter the "GTC") are intended to define the terms and conditions under which the company FICHA, a simplified joint-stock company with a capital of 11,160 euros, registered with the RCS of Grenoble under number 881 734 800, whose registered office is located at 12 Rue Pierre Semard, 38000 Grenoble (hereinafter "FICHA"), makes available to Users the Cocon mobile application (hereinafter the "Application").<\/p><p id=\"381d0c3c-37a8-4990-a972-8445463e74b6\" class=\"\" dir=\"auto\">The Application is made available to Users under a contract between FICHA and a local authority, a landlord, or any other partner (hereinafter the "Partner") who has subscribed to FICHA Services for one or more of its sites (hereinafter the "Location"). These Terms of Use apply exclusively to the relationship between FICHA and the User, a natural person using the Application; they are separate from and independent of the commercial contract between FICHA and the Partner, which is governed by FICHA's General Terms and Conditions of Sale and Services.<\/p><h2 id=\"19f9e99d-a318-4c0b-b8dc-f87b25f7b09d\" class=\"\" dir=\"auto\">Article 2 - Definitions<\/h2><p id=\"21bd159f-d557-4587-8d42-e222a40209c8\" class=\"\" dir=\"auto\"><strong>" Application "<\/strong> : the Cocon mobile application published by FICHA.<\/p><p id=\"db413197-3000-4335-b041-877b9ba482d6\" class=\"\" dir=\"auto\"><strong>"Terms of Use"<\/strong> : these general terms and conditions of use.<\/p><p id=\"a7ac8393-6dce-44aa-8a93-5553799fa2df\" class=\"\" dir=\"auto\"><strong>" Contribution "<\/strong> : any content (message, photo, comment) published by the User via the Application.<\/p><p id=\"b9c1a6d1-a124-4000-b4e4-be616b5187ca\" class=\"\" dir=\"auto\"><strong>\u201cPersonal Data\u201d<\/strong> : personal data as defined in Regulation (EU) 2016\/679 of 27 April 2016 (\u201cGDPR\u201d).<\/p><p id=\"73ed31a1-9df8-4824-9686-cce04a0eccd8\" class=\"\" dir=\"auto\"><strong>" Location "<\/strong> : the site (collective housing, etc.) on which the FICHA sensors associated with the Application are installed.<\/p><p id=\"1bbad0c9-a80b-4e15-9d10-a7c7b2f542c1\" class=\"\" dir=\"auto\"><strong>" Partner "<\/strong> : the entity (local authority, landlord, trustee, etc.) that has subscribed to the FICHA Services for one or more Locations, recipient of certain statistics from the use of the Application by Users.<\/p><p id=\"36d20be3-7fe8-45e5-b1ad-91bd451e723f\" class=\"\" dir=\"auto\"><strong>\u201cUser\u201d<\/strong> : any natural person using the Application for the purpose of sorting their waste.<\/p><h2 id=\"4db6d353-d941-4bc1-ab5e-070f8a8c5a8f\" class=\"\" dir=\"auto\">Article 3 - Acceptance of the Terms and Conditions<\/h2><p id=\"c4582aad-6216-48ef-882f-a26503aa5808\" class=\"\" dir=\"auto\">Access to and use of the Application are subject to the User's prior and unconditional acceptance of these Terms and Conditions. <\/p><h1 id=\"db459a1d-a4ad-44f3-86a1-70eba471fc21\" class=\"\" dir=\"auto\">II. Access to and use of the Application<\/h1><h2 id=\"89f7f049-a41c-4807-a721-85cfd3a3970a\" class=\"\" dir=\"auto\">Article 4 - Registration and Login<\/h2><p id=\"b5f8df08-68bf-4f7b-a193-eb8102d77c95\" class=\"\" dir=\"auto\">The User registers on the Application using their email address. Depending on the settings chosen by the Partner:<\/p><ul id=\"9820ddb4-f6d7-4a8d-bb20-a37d9e26022b\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">The User receives a one-time login link, valid for one (1) hour, sent to the email address provided; or<\/li><\/ul><ul id=\"6399c96e-fb78-4c5c-80e7-0b606554a066\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">The User can set a password to log in, when the Partner has activated this option, particularly when access to email is not guaranteed on the terminal used.<\/li><\/ul><p id=\"8c40bd05-0aac-4b4a-ad1b-084cf649ee0d\" class=\"\" dir=\"auto\">The User is solely responsible for maintaining the confidentiality of their account access credentials (email access, password if applicable) and for all activity conducted through their account. They agree to inform FICHA immediately of any unauthorized use of their account at the following address: <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><h2 id=\"0f7932c3-ef0f-44c0-ab35-7a8ef6135cac\" class=\"\" dir=\"auto\">Article 5 - Features<\/h2><p id=\"bf5af300-7d5a-4beb-95fe-6a559d7234e7\" class=\"\" dir=\"auto\">The Application allows the User to:<\/p><ul id=\"7cd7ebcf-1a93-4189-bf1e-7760168e3210\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">consult its waste sorting statistics, established from data collected by sensors installed on the Site;<\/li><\/ul><ul id=\"2dd0b102-ae5c-4b31-bd37-d6637615bd02\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">access to rewards or benefits determined based on sorting performance;<\/li><\/ul><ul id=\"85f39ae0-eab7-449f-9646-3afd4b83f567\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">Publish Contributions (messages, photos) under the conditions of article 6.<\/li><\/ul><p id=\"975fcf69-0ce8-4766-9d88-bca95b2f0ddd\" class=\"\" dir=\"auto\">FICHA reserves the right to modify the functionalities of the Application, in particular to improve it or adapt it to technical or regulatory developments, without this modification giving rise to any compensation for the User.<\/p><h2 id=\"9874b9c1-4a33-4e00-bc24-50e2109faf81\" class=\"\" dir=\"auto\">Article 6 - Contributions and moderation<\/h2><p id=\"ac3735f6-9e23-4147-a7eb-65fae35c723d\" class=\"\" dir=\"auto\">User contributions are visible to FICHA and the relevant Partner. The User agrees not to publish any illegal content, including any content constituting defamation, insult, infringement of intellectual property rights, glorification of crimes against humanity, incitement to or glorification of acts of terrorism, incitement to racial hatred or hatred based on sex, sexual orientation or gender identity or disability, pornographic content involving minors, incitement to violence \u2013 particularly violence against women \u2013 or any attack on human dignity.<\/p><p id=\"f6a00ade-778f-495f-b7be-086f8e0f044e\" class=\"\" dir=\"auto\">FICHA and the Partner each have the power to monitor and, where appropriate, remove any Contribution that constitutes illegal content. Any report can be sent to FICHA at the following address: <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><p id=\"44d9b0c6-1636-4f08-aade-e0e4fffd3d9d\" class=\"\" dir=\"auto\">By publishing a Contribution, the User grants FICHA and the Partner a non-exclusive and free license to use this Contribution, for the needs of the operation of the Application and within the limit of its purpose (sorting statistics, animation of the reward system).<\/p><h2 id=\"942d9ac3-c6a0-470f-81c5-e11865685014\" class=\"\" dir=\"auto\">Article 7 - User Commitments<\/h2><p id=\"2d50e263-2129-4539-89c6-f898bd39c1a7\" class=\"\" dir=\"auto\">The User agrees to use the Application in accordance with its intended purpose and these Terms of Use, not to interfere with the proper functioning of the Application or the rights of third parties, and not to attempt to access data or features that are not intended for him\/her.<\/p><h1 id=\"2a034a31-74b5-4042-8a11-3ec07345d1fe\" class=\"\" dir=\"auto\">III. Personal Data<\/h1><h2 id=\"52d10ef6-d539-4c42-9101-133e94b09e9d\" class=\"\" dir=\"auto\">Article 8 - Processing of User Data<\/h2><p id=\"2749baee-8cf9-4ae8-8855-6bda11f35f3d\" class=\"\" dir=\"auto\">FICHA processes the User's Personal Data under the conditions described in its <a href=\"https:\/\/ficha.fr\/en\/privacy-policy\/\">Privacy Policy<\/a>, available from the Application and on the FICHA website, which forms an integral part of these Terms and Conditions.<\/p><h2 id=\"93429086-d5b7-41f4-9ed8-f248a4b4c27f\" class=\"\" dir=\"auto\">Article 9 - Data Transmission to the Partner<\/h2><p id=\"099a6185-336e-4acb-805f-030310a3a2d4\" class=\"\" dir=\"auto\">As part of the system's operation, FICHA transmits certain User Personal Data to the Partner in connection with its sorting statistics (performance rates, Contributions, etc.). This transmission is necessary for the performance of the service provided to the User, which is financed by the Partner, and is based on the principle of contractual necessity (Article 6.1.b of the GDPR). The User is informed of this under these Terms of Service and FICHA's privacy policy, without their specific consent being required.<\/p><h2 id=\"c54b259d-56fe-4360-942c-d9021c911a16\" class=\"\" dir=\"auto\">Article 10 - User Rights<\/h2><p id=\"a01b19c0-abcb-448d-85e6-d68de2661293\" class=\"\" dir=\"auto\">In accordance with the GDPR, the User has the right to access, rectify, erase, restrict and object to the processing of their Personal Data, which they can exercise by contacting FICHA at the address <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>, under the conditions specified by the privacy policy.<\/p><h1 id=\"eddefd2f-e737-4f61-9728-94e90c544c76\" class=\"\" dir=\"auto\">IV. Intellectual Property<\/h1><h2 id=\"9561593d-f31f-427e-8352-cf2821ef893a\" class=\"\" dir=\"auto\">Article 11 - Application Ownership<\/h2><p id=\"3d58108d-1e6c-48f1-bc40-a855565d946b\" class=\"\" dir=\"auto\">FICHA is and remains the sole owner of all intellectual property rights related to the Application. The User's use of the Application does not grant them any intellectual property rights. The User is granted a personal, non-exclusive, and non-transferable right to use the Application solely for their waste sorting needs.<\/p><h1 id=\"a4d11ede-7301-49b9-8288-487236bad7bd\" class=\"\" dir=\"auto\">V. Responsibility and availability of the service<\/h1><h2 id=\"57bf977b-73e7-4667-9959-ad0645caccfc\" class=\"\" dir=\"auto\">Article 12 - Availability<\/h2><p id=\"a7bb3c00-9e86-4d58-8556-00ff6c351c89\" class=\"\" dir=\"auto\">FICHA will take reasonable steps to ensure the accessibility of the Application, but does not guarantee continuous availability. FICHA may temporarily suspend access to the Application for maintenance or improvement purposes, without such interruption entitling the User to any compensation.<\/p><h2 id=\"ca4cb51d-1ebd-4f40-a75a-b0d0c347c3c6\" class=\"\" dir=\"auto\">Article 13 - Limitation of Liability<\/h2><p id=\"4b1a4ed5-70dd-4edf-9f1c-920369d823fa\" class=\"\" dir=\"auto\">FICHA is only bound by an obligation of means in providing the Application. Its liability can only be invoked in the event of proven fault on the part of the User, and in any case, it will be excluded for any indirect damage. FICHA cannot be held liable for damages resulting from use of the Application that does not comply with these Terms of Use, nor for Contributions published by other Users.<\/p><h1 id=\"d9100d97-f1ab-43f0-8f78-2b66235edaa9\" class=\"\" dir=\"auto\">VI. Duration, suspension and termination<\/h1><h2 id=\"5cb24c45-8ec4-4e97-bd1c-c62e1ba370a7\" class=\"\" dir=\"auto\">Article 14 - Duration<\/h2><p id=\"a5f0f3cb-cd94-42c0-b04b-c9115b9f2c6a\" class=\"\" dir=\"auto\">These Terms of Use apply for the entire duration of the User's use of the Application.<\/p><h2 id=\"1673dda7-bdf8-4ec6-9395-eb58f6d49e95\" class=\"\" dir=\"auto\">Article 15 - Termination by the User<\/h2><p id=\"b9b07a1e-a8e8-4237-86e7-202075801ac2\" class=\"\" dir=\"auto\">The User may at any time cease using the Application and request the deletion of their account by contacting FICHA at the address <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><h2 id=\"78ea3ee5-0e7e-4bc6-87bc-9830f2e53647\" class=\"\" dir=\"auto\">Article 16 - Suspension or termination by FICHA<\/h2><p id=\"1a91c68d-d535-4510-abb9-cdb434b18fd2\" class=\"\" dir=\"auto\">FICHA may suspend or delete, at any time and without notice in the event of serious misconduct, a User's access to the Application, in particular in the event of publication of illegal content or breach of these Terms and Conditions.<\/p><h2 id=\"f9590ac5-7fa4-4131-8968-3c972454d3e9\" class=\"\" dir=\"auto\">Article 17 - Consequences of the termination of the contract with the Partner<\/h2><p id=\"e54af55b-beda-419c-936e-8ca03abefe29\" class=\"\" dir=\"auto\">In the event of termination or non-renewal of the contract between FICHA and the Partner for the Location in question, the User's access to the Application will be closed, subject to two (2) months' notice when circumstances permit. The User's Personal Data will then be retained and subsequently deleted in accordance with FICHA's privacy policy.<\/p><h1 id=\"cd52abfe-dd2e-4faf-8a2f-c4e62dbe5439\" class=\"\" dir=\"auto\">VII. Modification of the Terms and Conditions<\/h1><h2 id=\"1b9141d0-c7c2-41f8-b246-bb1f46c8189b\" class=\"\" dir=\"auto\">Article 18<\/h2><p id=\"a8274675-9c50-4977-a2bf-a2bbd14a179f\" class=\"\" dir=\"auto\">FICHA reserves the right to modify these Terms of Use at any time. Users will be notified of any substantial changes by notification within the Application or by email before they take effect. Continued use of the Application after this notification constitutes acceptance of the modified Terms of Use.<\/p><h1 id=\"3c2fd3ef-7175-4194-add3-6744e4cd2929\" class=\"\" dir=\"auto\">VIII. Final Provisions<\/h1><h2 id=\"1c0f3440-959e-4cc9-b5ea-8dfcaa323e5c\" class=\"\" dir=\"auto\">Article 19 - Complaints and Mediation<\/h2><p id=\"f733b3a3-1fc8-4ef7-ae0d-90003ed48dc3\" class=\"\" dir=\"auto\">Any complaint relating to the use of the Application can be addressed to FICHA at the following address <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><p id=\"392cccb0-c7b8-8016-9ad4-e59761caac6a\" class=\"\" dir=\"auto\">Disputes will first be settled through mediation within 30 days. If mediation fails, the parties may resort to arbitration or a competent court, according to the terms of the main contract.<\/p><h2 id=\"9b613e7d-9e59-428f-9584-30c5981278d0\" class=\"\" dir=\"auto\">Article 20 - Applicable Law and Disputes<\/h2><p id=\"94f05921-483e-47c2-9d34-3e5e7c113610\" class=\"\" dir=\"auto\">These Terms and Conditions are governed by French law. \n\t\t\t\t\tCGU - Application Cocon<\/title><\/head><body><article id=\"391cccb0-c7b8-81fb-8734-d47cb31cf9c4\" class=\"page sans\"><header><h1 class=\"page-title\" dir=\"auto\">Terms of Service - Cocon Application<\/h1><p class=\"page-description\" dir=\"auto\"><\/p><\/header><div class=\"page-body\"><h1 id=\"ac145f0c-ef20-4adc-9710-2d16828e3ddc\" class=\"\" dir=\"auto\">I. General Provisions<\/h1><h2 id=\"234bb9ed-9768-4cba-84a4-dc32da6566b6\" class=\"\" dir=\"auto\">Article 1 - Preamble<\/h2><p id=\"d7c3adb2-8009-4ab4-bb62-53c14c6ce456\" class=\"\" dir=\"auto\">These General Terms and Conditions of Use (hereinafter the "GTC") are intended to define the terms and conditions under which the company FICHA, a simplified joint-stock company with a capital of 11,160 euros, registered with the RCS of Grenoble under number 881 734 800, whose registered office is located at 12 Rue Pierre Semard, 38000 Grenoble (hereinafter "FICHA"), makes available to Users the Cocon mobile application (hereinafter the "Application").<\/p><p id=\"381d0c3c-37a8-4990-a972-8445463e74b6\" class=\"\" dir=\"auto\">The Application is made available to Users under a contract between FICHA and a local authority, a landlord, or any other partner (hereinafter the "Partner") who has subscribed to FICHA Services for one or more of its sites (hereinafter the "Location"). These Terms of Use apply exclusively to the relationship between FICHA and the User, a natural person using the Application; they are separate from and independent of the commercial contract between FICHA and the Partner, which is governed by FICHA's General Terms and Conditions of Sale and Services.<\/p><h2 id=\"19f9e99d-a318-4c0b-b8dc-f87b25f7b09d\" class=\"\" dir=\"auto\">Article 2 - Definitions<\/h2><p id=\"21bd159f-d557-4587-8d42-e222a40209c8\" class=\"\" dir=\"auto\"><strong>" Application "<\/strong> : the Cocon mobile application published by FICHA.<\/p><p id=\"db413197-3000-4335-b041-877b9ba482d6\" class=\"\" dir=\"auto\"><strong>"Terms of Use"<\/strong> : these general terms and conditions of use.<\/p><p id=\"a7ac8393-6dce-44aa-8a93-5553799fa2df\" class=\"\" dir=\"auto\"><strong>" Contribution "<\/strong> : any content (message, photo, comment) published by the User via the Application.<\/p><p id=\"b9c1a6d1-a124-4000-b4e4-be616b5187ca\" class=\"\" dir=\"auto\"><strong>\u201cPersonal Data\u201d<\/strong> : personal data as defined in Regulation (EU) 2016\/679 of 27 April 2016 (\u201cGDPR\u201d).<\/p><p id=\"73ed31a1-9df8-4824-9686-cce04a0eccd8\" class=\"\" dir=\"auto\"><strong>" Location "<\/strong> : the site (collective housing, etc.) on which the FICHA sensors associated with the Application are installed.<\/p><p id=\"1bbad0c9-a80b-4e15-9d10-a7c7b2f542c1\" class=\"\" dir=\"auto\"><strong>" Partner "<\/strong> : the entity (local authority, landlord, trustee, etc.) that has subscribed to the FICHA Services for one or more Locations, recipient of certain statistics from the use of the Application by Users.<\/p><p id=\"36d20be3-7fe8-45e5-b1ad-91bd451e723f\" class=\"\" dir=\"auto\"><strong>\u201cUser\u201d<\/strong> : any natural person using the Application for the purpose of sorting their waste.<\/p><h2 id=\"4db6d353-d941-4bc1-ab5e-070f8a8c5a8f\" class=\"\" dir=\"auto\">Article 3 - Acceptance of the Terms and Conditions<\/h2><p id=\"c4582aad-6216-48ef-882f-a26503aa5808\" class=\"\" dir=\"auto\">Access to and use of the Application are subject to the User's prior and unconditional acceptance of these Terms and Conditions. <\/p><h1 id=\"db459a1d-a4ad-44f3-86a1-70eba471fc21\" class=\"\" dir=\"auto\">II. Access to and use of the Application<\/h1><h2 id=\"89f7f049-a41c-4807-a721-85cfd3a3970a\" class=\"\" dir=\"auto\">Article 4 - Registration and Login<\/h2><p id=\"b5f8df08-68bf-4f7b-a193-eb8102d77c95\" class=\"\" dir=\"auto\">The User registers on the Application using their email address. Depending on the settings chosen by the Partner:<\/p><ul id=\"9820ddb4-f6d7-4a8d-bb20-a37d9e26022b\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">The User receives a one-time login link, valid for one (1) hour, sent to the email address provided; or<\/li><\/ul><ul id=\"6399c96e-fb78-4c5c-80e7-0b606554a066\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">The User can set a password to log in, when the Partner has activated this option, particularly when access to email is not guaranteed on the terminal used.<\/li><\/ul><p id=\"8c40bd05-0aac-4b4a-ad1b-084cf649ee0d\" class=\"\" dir=\"auto\">The User is solely responsible for maintaining the confidentiality of their account access credentials (email access, password if applicable) and for all activity conducted through their account. They agree to inform FICHA immediately of any unauthorized use of their account at the following address: <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><h2 id=\"0f7932c3-ef0f-44c0-ab35-7a8ef6135cac\" class=\"\" dir=\"auto\">Article 5 - Features<\/h2><p id=\"bf5af300-7d5a-4beb-95fe-6a559d7234e7\" class=\"\" dir=\"auto\">The Application allows the User to:<\/p><ul id=\"7cd7ebcf-1a93-4189-bf1e-7760168e3210\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">consult its waste sorting statistics, established from data collected by sensors installed on the Site;<\/li><\/ul><ul id=\"2dd0b102-ae5c-4b31-bd37-d6637615bd02\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">access to rewards or benefits determined based on sorting performance;<\/li><\/ul><ul id=\"85f39ae0-eab7-449f-9646-3afd4b83f567\" class=\"bulleted-list\" dir=\"auto\"><li style=\"list-style-type:disc\">Publish Contributions (messages, photos) under the conditions of article 6.<\/li><\/ul><p id=\"975fcf69-0ce8-4766-9d88-bca95b2f0ddd\" class=\"\" dir=\"auto\">FICHA reserves the right to modify the functionalities of the Application, in particular to improve it or adapt it to technical or regulatory developments, without this modification giving rise to any compensation for the User.<\/p><h2 id=\"9874b9c1-4a33-4e00-bc24-50e2109faf81\" class=\"\" dir=\"auto\">Article 6 - Contributions and moderation<\/h2><p id=\"ac3735f6-9e23-4147-a7eb-65fae35c723d\" class=\"\" dir=\"auto\">User contributions are visible to FICHA and the relevant Partner. The User agrees not to publish any illegal content, including any content constituting defamation, insult, infringement of intellectual property rights, glorification of crimes against humanity, incitement to or glorification of acts of terrorism, incitement to racial hatred or hatred based on sex, sexual orientation or gender identity or disability, pornographic content involving minors, incitement to violence \u2013 particularly violence against women \u2013 or any attack on human dignity.<\/p><p id=\"f6a00ade-778f-495f-b7be-086f8e0f044e\" class=\"\" dir=\"auto\">FICHA and the Partner each have the power to monitor and, where appropriate, remove any Contribution that constitutes illegal content. Any report can be sent to FICHA at the following address: <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><p id=\"44d9b0c6-1636-4f08-aade-e0e4fffd3d9d\" class=\"\" dir=\"auto\">By publishing a Contribution, the User grants FICHA and the Partner a non-exclusive and free license to use this Contribution, for the needs of the operation of the Application and within the limit of its purpose (sorting statistics, animation of the reward system).<\/p><h2 id=\"942d9ac3-c6a0-470f-81c5-e11865685014\" class=\"\" dir=\"auto\">Article 7 - User Commitments<\/h2><p id=\"2d50e263-2129-4539-89c6-f898bd39c1a7\" class=\"\" dir=\"auto\">The User agrees to use the Application in accordance with its intended purpose and these Terms of Use, not to interfere with the proper functioning of the Application or the rights of third parties, and not to attempt to access data or features that are not intended for him\/her.<\/p><h1 id=\"2a034a31-74b5-4042-8a11-3ec07345d1fe\" class=\"\" dir=\"auto\">III. Personal Data<\/h1><h2 id=\"52d10ef6-d539-4c42-9101-133e94b09e9d\" class=\"\" dir=\"auto\">Article 8 - Processing of User Data<\/h2><p id=\"2749baee-8cf9-4ae8-8855-6bda11f35f3d\" class=\"\" dir=\"auto\">FICHA processes the User's Personal Data under the conditions described in its <a href=\"https:\/\/ficha.fr\/en\/privacy-policy\/\">Privacy Policy<\/a>, available from the Application and on the FICHA website, which forms an integral part of these Terms and Conditions.<\/p><h2 id=\"93429086-d5b7-41f4-9ed8-f248a4b4c27f\" class=\"\" dir=\"auto\">Article 9 - Data Transmission to the Partner<\/h2><p id=\"099a6185-336e-4acb-805f-030310a3a2d4\" class=\"\" dir=\"auto\">As part of the system's operation, FICHA transmits certain User Personal Data to the Partner in connection with its sorting statistics (performance rates, Contributions, etc.). This transmission is necessary for the performance of the service provided to the User, which is financed by the Partner, and is based on the principle of contractual necessity (Article 6.1.b of the GDPR). The User is informed of this under these Terms of Service and FICHA's privacy policy, without their specific consent being required.<\/p><h2 id=\"c54b259d-56fe-4360-942c-d9021c911a16\" class=\"\" dir=\"auto\">Article 10 - User Rights<\/h2><p id=\"a01b19c0-abcb-448d-85e6-d68de2661293\" class=\"\" dir=\"auto\">In accordance with the GDPR, the User has the right to access, rectify, erase, restrict and object to the processing of their Personal Data, which they can exercise by contacting FICHA at the address <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>, under the conditions specified by the privacy policy.<\/p><h1 id=\"eddefd2f-e737-4f61-9728-94e90c544c76\" class=\"\" dir=\"auto\">IV. Intellectual Property<\/h1><h2 id=\"9561593d-f31f-427e-8352-cf2821ef893a\" class=\"\" dir=\"auto\">Article 11 - Application Ownership<\/h2><p id=\"3d58108d-1e6c-48f1-bc40-a855565d946b\" class=\"\" dir=\"auto\">FICHA is and remains the sole owner of all intellectual property rights related to the Application. The User's use of the Application does not grant them any intellectual property rights. The User is granted a personal, non-exclusive, and non-transferable right to use the Application solely for their waste sorting needs.<\/p><h1 id=\"a4d11ede-7301-49b9-8288-487236bad7bd\" class=\"\" dir=\"auto\">V. Responsibility and availability of the service<\/h1><h2 id=\"57bf977b-73e7-4667-9959-ad0645caccfc\" class=\"\" dir=\"auto\">Article 12 - Availability<\/h2><p id=\"a7bb3c00-9e86-4d58-8556-00ff6c351c89\" class=\"\" dir=\"auto\">FICHA will take reasonable steps to ensure the accessibility of the Application, but does not guarantee continuous availability. FICHA may temporarily suspend access to the Application for maintenance or improvement purposes, without such interruption entitling the User to any compensation.<\/p><h2 id=\"ca4cb51d-1ebd-4f40-a75a-b0d0c347c3c6\" class=\"\" dir=\"auto\">Article 13 - Limitation of Liability<\/h2><p id=\"4b1a4ed5-70dd-4edf-9f1c-920369d823fa\" class=\"\" dir=\"auto\">FICHA is only bound by an obligation of means in providing the Application. Its liability can only be invoked in the event of proven fault on the part of the User, and in any case, it will be excluded for any indirect damage. FICHA cannot be held liable for damages resulting from use of the Application that does not comply with these Terms of Use, nor for Contributions published by other Users.<\/p><h1 id=\"d9100d97-f1ab-43f0-8f78-2b66235edaa9\" class=\"\" dir=\"auto\">VI. Duration, suspension and termination<\/h1><h2 id=\"5cb24c45-8ec4-4e97-bd1c-c62e1ba370a7\" class=\"\" dir=\"auto\">Article 14 - Duration<\/h2><p id=\"a5f0f3cb-cd94-42c0-b04b-c9115b9f2c6a\" class=\"\" dir=\"auto\">These Terms of Use apply for the entire duration of the User's use of the Application.<\/p><h2 id=\"1673dda7-bdf8-4ec6-9395-eb58f6d49e95\" class=\"\" dir=\"auto\">Article 15 - Termination by the User<\/h2><p id=\"b9b07a1e-a8e8-4237-86e7-202075801ac2\" class=\"\" dir=\"auto\">The User may at any time cease using the Application and request the deletion of their account by contacting FICHA at the address <a href=\"mailto:support@ficha.fr\">support@ficha.fr<\/a>.<\/p><h2 id=\"78ea3ee5-0e7e-4bc6-87bc-9830f2e53647\" class=\"\" dir=\"auto\">Article 16 - Suspension or termination by FICHA<\/h2><p id=\"1a91c68d-d535-4510-abb9-cdb434b18fd2\" class=\"\" dir=\"auto\">FICHA may suspend or delete, at any time and without notice in the event of serious misconduct, a User's access to the Application, in particular in the event of publication of illegal content or breach of these Terms and Conditions.<\/p><h2 id=\"f9590ac5-7fa4-4131-8968-3c972454d3e9\" class=\"\" dir=\"auto\">Article 17 - Consequences of the termination of the contract with the Partner<\/h2><p id=\"e54af55b-beda-419c-936e-8ca03abefe29\" class=\"\" dir=\"auto\">In the event of termination or non-renewal of the contract between FICHA and the Partner for the Location in question, the User's access to the Application will be closed, subject to two (2) months' notice when circumstances permit. The User's Personal Data will then be retained and subsequently deleted in accordance with FICHA's privacy policy.<\/p><h1 id=\"cd52abfe-dd2e-4faf-8a2f-c4e62dbe5439\" class=\"\" dir=\"auto\">VII. Modification of the Terms and Conditions<\/h1><h2 id=\"1b9141d0-c7c2-41f8-b246-bb1f46c8189b\" class=\"\" dir=\"auto\">Article 18<\/h2><p id=\"a8274675-9c50-4977-a2bf-a2bbd14a179f\" class=\"\" dir=\"auto\">FICHA reserves the right to modify these Terms of Use at any time. Users will be notified of any substantial changes by notification within the Application or by email before they take effect. Continued use of the Application after this notification constitutes acceptance of the modified Terms of Use.<\/p><h1 id=\"3c2fd3ef-7175-4194-add3-6744e4cd2929\" class=\"\" dir=\"auto\">VIII.
