{"id":4403,"date":"2023-02-10T08:59:39","date_gmt":"2023-02-10T08:59:39","guid":{"rendered":"https:\/\/ficha.fr\/?p=4403"},"modified":"2025-05-18T10:25:15","modified_gmt":"2025-05-18T10:25:15","slug":"tgap-en-2023-fonctionnement-calcul-et-enjeux","status":"publish","type":"post","link":"https:\/\/ficha.fr\/en\/tgap-en-2023-fonctionnement-calcul-et-enjeux","title":{"rendered":"TGAP in 2023: operation, calculation and challenges"},"content":{"rendered":"<h2 class=\"wp-block-heading\">What is TGAP?<\/h2>\n\n\n\n<p>The TGAP, or General Tax on Polluting Activities, is a tax which concerns companies with a <strong>polluting activity or which use polluting products<\/strong>.<\/p>\n\n\n\n<p>Initially included in article 45 of the finance law for 1999, this tax has been in force in France since January 1, 2000. The objective of the TGAP is to:<strong>Optimize waste management<\/strong>, by promoting their <strong>sorting<\/strong>, their <strong>recycling<\/strong> and their <strong>reuse<\/strong>, and to reduce the quantity of non-recyclable waste.<\/p>\n\n\n\n<p>The companies concerned are taxed on the <strong>tonnage of waste intended for incineration or landfill<\/strong>. The long-term objective of the TGAP is to reduce GHG emissions by 21 % by 2025 and by 40 % by 2030, compared to 1990.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who should pay TGAP?<\/h2>\n\n\n\n<p>Any company that <strong>collection of waste which is subsequently stored and treated <\/strong>must pay the TGAP in 2023. It is the waste operators who collect it, adding the tax to the cost of waste treatment.<\/p>\n\n\n\n<p>Depending on the nature of their activity, some companies may be <strong>exempted<\/strong> of TGAP. To find out if your company is one of the exempt entities, go to the <a href=\"https:\/\/entreprendre.service-public.fr\/vosdroits\/F23497\">public service website<\/a>.<\/p>\n\n\n\n<p>In some cases, TGAP may concern the <strong>individuals<\/strong>. In addition, waste disposal sites increasingly tend to tax their users financially, due to the polluting nature of the treatment of waste deposited there.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What waste does the TGAP apply to in 2023?<\/h2>\n\n\n\n<p>The TGAP applies to the products or polluting emissions of companies. Depending on their activity, there are two categories of TGAP:<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-neve-link-hover-color-color has-text-color has-medium-font-size\">TGAP \u201cWaste\u201d<\/h3>\n\n\n\n<p>The TGAP \u201cWaste\u201d component concerns all activities of <strong>storage<\/strong> of hazardous or non-hazardous waste, their <strong>treatment<\/strong> (incineration or co-incineration) or their <strong>transfer<\/strong> <strong>to another country<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Non-hazardous waste<\/strong> : household waste collected by local authorities. It also includes ferrous and non-ferrous metals, plastics, untreated wood, paper and cardboard, uncontaminated packaging, construction waste, rubble and green waste.<\/li>\n\n\n\n<li><strong>Waste<\/strong> <strong>dangerous<\/strong> : containing toxic or dangerous elements presenting risks to human health or the environment.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-neve-link-hover-color-color has-text-color has-medium-font-size\">TGAP \u201cNon-Waste\u201d<\/h3>\n\n\n\n<p>In the TGAP \u201cNon-Waste\u201d component, we find:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pollutant emissions:<\/strong> all releases of emissions harmful to the environment, such as sulfur oxides or solvents.<\/li>\n\n\n\n<li><strong>Laundry:<\/strong> any delivery and use of detergents, washing preparations and fabric softeners, depending on their phosphate content.<\/li>\n\n\n\n<li><strong>THE<\/strong> <strong>extraction materials:<\/strong> any delivery or use of extracted materials of any origin.<\/li>\n<\/ul>\n\n\n\n<p>The TGAP does not apply to the recycling of materials that have already been sorted, such as paper, cardboard or biowaste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How is the TGAP calculated in 2023?<\/h2>\n\n\n\n<p>The TGAP rate is set each year <strong>for each ton of waste<\/strong>. The amount of tax varies depending on the <strong>kind<\/strong> <strong>of waste <\/strong>concerned and the<strong>business activity<\/strong> liable, as well as the<strong> type of treatment performed<\/strong> (burial or incineration).<\/p>\n\n\n\n<p>Entities liable for TGAP are required to keep a <strong>tonnage register<\/strong>This must include the nature of the waste, its treatment, its origin and the identity of the producer.<\/p>\n\n\n\n<p>There <strong>statement s<\/strong>e<strong> made online<\/strong>, on the tax website. The tax is paid in two installments, with a deposit being paid in October. Then, the balance is paid in April and May of the following year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Increase in TGAP<\/h2>\n\n\n\n<p>To combat waste and related pollution, the government <strong>increase<\/strong> <strong>the TGAP rate has increased significantly since 2021<\/strong>The aim of this increase is to limit waste production and encourage recycling.<\/p>\n\n\n\n<p>By 2023, every tonne of non-hazardous waste sent to <strong>burial<\/strong> will be taxed at a rate of \u20ac52 per tonne. By 2025, the tax will reach <strong>65\u20ac<\/strong>. For a ton of waste sent to <strong>incineration<\/strong>, the tax currently at \u20ac20, will reach <strong>25\u20ac per ton<\/strong>.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/ficha.fr\/wp-content\/uploads\/2023\/02\/Untitled.png\" alt=\"Graphique de l\u2019\u00e9volution de la TGAP\/ tonne d\u2019ici 2025 \" class=\"wp-image-4408\" style=\"width:512px;height:384px\" title=\"Evolution of the TGAP rate per tonne by 2025 \" srcset=\"https:\/\/ficha.fr\/wp-content\/uploads\/2023\/02\/Untitled.png 1024w, https:\/\/ficha.fr\/wp-content\/uploads\/2023\/02\/Untitled-300x225.png 300w, https:\/\/ficha.fr\/wp-content\/uploads\/2023\/02\/Untitled-768x576.png 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n<p>Every year until 2025, the TGAP rate will be reassessed upwards. <a href=\"https:\/\/bofip.impots.gouv.fr\/bofip\/12765-PGP.html\/identifiant=BOI-BAREME-000039-20221207\" target=\"_blank\" rel=\"noreferrer noopener\">full scale<\/a> on TGAP rates in 2023 is available on the Official Bulletin of Public Finances \u2013 Taxes website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What impact for communities and waste operators?<\/h2>\n\n\n\n<p>THE <strong>waste<\/strong> <strong>household<\/strong> are considered non-hazardous waste, and are targeted by the TGAP. Their collection is managed either by local authorities, or by public service delegation with waste operators.<\/p>\n\n\n\n<p>THE<strong> local authorities<\/strong> are generally not subject to the TGAP, as they are not considered businesses. However, the tax on polluting activities may apply to some of their activities such as waste management. The TGAP may apply to<strong> greenhouse gas emissions from the facilities they operate<\/strong>, such as wastewater treatment plants, incinerators, landfills or power plants.<\/p>\n\n\n\n<p>For their part, the <strong>waste operators<\/strong> may also be subject to TGAP. The tax applies <strong>according to CO2 emissions from incineration<\/strong> waste or methane emissions from <strong>dumps<\/strong>.<\/p>\n\n\n\n<p>The increase in the TGAP is synonymous with an increase in the cost of treatment by local authorities and waste operators. It is therefore necessary to <strong>reduce waste production and optimize its sorting and recycling<\/strong>.
