Camia Terms and Conditions

I. General Provisions

Article 1 - Purpose

These General Terms and Conditions of Use (hereinafter the "GTC") are intended to define the terms and conditions under which the company FICHA, a simplified joint-stock company with a capital of 11,160 euros, registered with the RCS of Grenoble under number 881 734 800, whose registered office is located at 12 Rue Pierre Semard, 38000 Grenoble (hereinafter "FICHA"), makes available to a User access to the Camia platform (hereinafter the "Service").

The Service is provided to the Client under a Contract between FICHA and the Client, governed by FICHA's General Terms and Conditions of Sale and Service (hereinafter referred to as the "GTC"). These Terms of Use supplement this Contract and govern the individual relationship between FICHA and each User in the daily use of the Service. In the event of any conflict between these Terms of Use and the GTC, the GTC shall prevail with regard to the Client's obligations to FICHA.

Article 2 - Definitions

The terms defined below are consistent with the definitions in FICHA's General Terms and Conditions of Sale and Services.

“Ambassador” : any natural person charged, on behalf of the Client, with carrying out targeted awareness actions among Users on the basis of the Missions created from the Service, whether they are an employee of the Client or of a service provider mandated by the latter for this purpose.

" Customer " : the legal entity (local authority, collection operator, or any other partner) having entered into a Contract with FICHA for access to the Service.

" Data " : waste characterization data and associated data, generated by the Products (Camia sensors and on-board cameras) and accessible via the Service.

" Assignment " : targeted awareness campaign, created from the Service by a User and assigned to one or more Ambassadors, focusing on addresses identified from the Data.

"Products" : the sensors and on-board devices developed by FICHA, including the Camia detection system installed on collection vehicles.

" Service " : the Camia application platform developed by FICHA, allowing the Client and its Users to view the Data generated by the Products.

" User " : any natural person, under the authority of the Client, authorized by the latter to use the Service.

II. Access to the Service

Article 3 - Allocation of access

In accordance with the General Terms and Conditions, the Client provides FICHA with the email addresses of the authorized Users so that they can be assigned a username and password. The Client manages the creation, modification of access rights, and deactivation of User accounts themselves via their administration interface, particularly when a User ceases their duties or no longer needs access to the Service.

Article 3bis - Access for Ambassadors

Ambassadors access the mobile application dedicated to Missions under the same allocation procedures as Users (article 3), provided that the Client communicates to FICHA the email addresses concerned, whether they are employees of the Client or external service providers that it mandates for this purpose.

When the Ambassador is an external service provider, the Client is solely responsible for ensuring that the contract binding it to that provider expressly covers the use of the Service under the terms of these General Terms and Conditions of Use, as well as the latter's compliance with the confidentiality and data protection obligations applicable to Ambassadors. The Client informs FICHA of the status (employee or service provider) of each Ambassador whose access it requests.

Article 4 - User Responsibility for Access

The User is solely responsible for maintaining the confidentiality of their username and password, as well as for all activity carried out using their account. They agree not to disclose them to any third party, including another User, and to promptly inform the Client and FICHA (at the address support@ficha.fr) of any unauthorized use of their account.

In accordance with the General Terms and Conditions, the Client assumes responsibility for the security of individual access points to the Service and undertakes to allow access to the Service only to authorized members of its staff.

III. Use of the Service

Article 5 - Features

The Service allows the User to:

  • consult the detection data generated by the Products installed on the Customer's collection vehicles;
  • report to FICHA, via the dedicated dashboard function, any incorrect detection or anomaly noted on an image, in order to contribute to the improvement of the system;
  • Create targeted awareness missions from the data, and assign them to one or more Ambassadors, who access them via the dedicated mobile application and record their visit reports (with photos if necessary); these reports can then be viewed by the User, individually and in aggregate.

Article 6 - Restrictions on use

The User agrees to use the Service in accordance with its intended professional purpose and within the limits of the access rights granted to them by the Client. In accordance with the General Terms and Conditions of Sale, the right to use the Service is granted to the Client solely for their own needs and does not imply any right to reproduce, adapt, distribute, or commercially exploit the Data or the Service; the User agrees to respect these same limits in the context of their individual use.

The User agrees not to attempt to access Data or functionalities that are not within their scope of authorization, nor to impair the proper functioning of the Service.

IV. User's Personal Data

Article 7 - Processing of identification data

FICHA processes the User's and Ambassador's identification data (name, email address) solely to enable them to access the Service and manage their account, based on the contractual necessity related to the performance of the Contract concluded with the Client. For external service provider Ambassadors, this legal basis requires that the Client has duly authorized the service provider in question under the conditions of Article 4bis.

Article 8 - User Rights

In accordance with the GDPR, the User has the right to access, rectify and object to data concerning him/her, which he/she can exercise by contacting FICHA at the address support@ficha.fr, under the conditions specified by FICHA's privacy policy.

V. Responsibility

Article 9 - Limitation of Liability

FICHA is only bound by an obligation of means in providing the Service. FICHA's liability to the User can only be invoked in the event of proven fault and is excluded for any indirect damages. The terms of liability applicable to the FICHA/Client relationship remain governed by the General Terms and Conditions of Sale.

Article 10 - Availability

FICHA implements reasonable means to ensure the accessibility of the Service, under the conditions of availability and maintenance described in the General Terms and Conditions.

VI. Duration and end of access

Article 11 - Duration

The User's access to the Service is valid for the entire duration of the Contract concluded between FICHA and the Client, subject to the Client maintaining its authorization.

Article 12 - End of access

The User's access to the Service ends if the Client deactivates their account via their administration interface, or upon the expiry or termination of the Contract concluded between FICHA and the Client, according to the terms and conditions set out in the General Terms and Conditions.

VII. Modification of the Terms and Conditions

Article 13

FICHA reserves the right to modify these Terms of Service at any time. Users will be notified of any substantial changes by notification within the Service or by email before they take effect. Continued use of the Service after this notification constitutes acceptance of the modified Terms of Service.

VIII. Final Provisions

Article 14 - Applicable Law and Disputes

These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or performance shall, in the absence of an amicable settlement, fall under the jurisdiction of the Commercial Court of Grenoble, in accordance with the provisions of the General Terms and Conditions of Sale applicable to the relationship between FICHA and the Client.
